(CMR) Police Constable Anthony Marshall was sentenced to five years in prison, while his female companion Ericka J. Lynch got 4 and a half years after they were convicted for indecent assault. They were sentenced this morning, 30 September.
The two were charged after a female alleged they sexually assaulted her. They never denied that the act took place but said the victim had consented to the acts and was a willing participant.
Both defendants faced a charge of indecent assault for sex performed on the victim. Marshall was accused of performing oral sex, and Lynch participated by engaging in sexual acts with the victim's breasts.
Justice Marlene Carter, in handing down the sentences, said the victim was left traumatized by the ordeal. The judge also imposed a sexual harm prevention order which prevents the couple from contacting the victim after serving their sentences.
In this unusual case, the matter came to the police's attention after the victim confided in another officer about the assault. He, in turn, sought legal advice and reported the matter to the Professional Standards Unit (PSU), who in turn encouraged the victim to come forward. The victim eventually made a formal complaint.
