(CMR) The case against Member of Parliament McKeeva Bush, who was on trial for two counts of indecent assault, has been discharged by the Grand Court on the grounds of abuse of process.
The defense applied for a stay of proceedings after the prosecution disclosed certain information, including emails and other documents, on Monday and Tuesday.
Based on the information disclosed, along with submissions from the prosecution and defense, Acting Justice Stanley John made the decision to stay the proceedings.
In giving reasons for his decision, Justice John posed the question, ” Would a right-minded citizen hearing the process used to have the defendant brought before the Court…not have serious concerns?”
Justice John said, “The court is therefore concerned with the process, and I stress, the process by which the decision to prosecute was made… The entire process has caused a level of disquiet.”
The Office of the DPP has not indicated its intention to pursue the matter any further.
