(CMR) Cory Shamar Pusey (34), who was accused of pointing a firearm at his ex-wife and sending her videos of him posing on her rooftop with a gun, was found not guilty by a jury in the Grand Court on Thursday following a four-day trial.
Pusey was charged with one count of possession of an imitation firearm after he was accused of pointing a gun at his ex-wife on a night in April 2022 during a visit to her home. While the incident was said to happen in 2022, the woman did not report it to the police until last year following an altercation.
Pusey was freed a day after he told jurors he had no access to firearms in the Cayman Islands and that the footage of him with the gun was shot a decade ago on the roof of a family member's home in Jamaica.
The court heard that Pusey visited his uncle, a police officer, regularly when he was attending boarding school in Jamaica between 2004 and 2008 and while he was in Jamaica between 2010 and 2014. He claimed the video of him with a gun on a roof was during one of his visits to his uncle.
However, his ex-wife claimed the videos were shot on the roof of her home in Bodden Town and that her neighbors’ houses can be seen in the background.
During the trial, the woman testified that her phone, on which her ex-husband had sent the videos, had been destroyed after she dropped it, and it could not be repaired.
Pusey, however, claimed he had never sent the videos to anyone and that his ex-wife was the only person with access to his phone password. His lawyer, Clinton Phuran, argued that Pusey’s ex-wife made up the allegations.
The woman reportedly made a complaint to the police in 2023 after Pusey was arrested in relation to a confrontation with her boyfriend during a visit to her home.
The court heard that Pusey visited her home at about 3 a.m. in July last year to discuss his relationship with their four children when the woman's boyfriend came to his car window and started hitting him. Pusey hit the man with a spray can and drove off. He was arrested by the police. It was then that a report was filed of the 2022 incident.
