(CMR) A local Cayman Airways worker had made social media news after he entered into a private car rental arrangement with a friend.
It is being alleged that Brandon Elliott Washington agreed to rent a car for a month at a rate of CI$805.00. The full details were laid out in a post that quickly went viral on social media.
Many Facebook posters found the arrangement peculiar and parties are encouraged to have all aspects of an arrangement in writing. CMR contacted a lawyer and was advised that most often these arrangements are civil in nature and the police are unlikely to intervene in any meaningful way. They offered the following advice:
“We would suggest that parties put everything in writing. Even if you're trying to help out a friend it's still an arrangement and a binding contract. So that there is no “she said, he said” put the terms in writing and have an independent third party witness the transaction. That will solidify what can and cannot be done. Furthermore, a contract would always discuss what remedies are available should there be a breach of the basic terms.”
It seems the parties would have benefited from going to a proper car rental agency instead.
