(CMR) A police officer has filed a lawsuit against the Commissioner of Police, the Cayman Islands Government, the Attorney General, and Montpelier Properties for negligence in relation to injuries she suffered in a malfunctioning elevator in 2020.
According to the court document, Detective Constable Jody-Ann Wignal, who was employed to the Firearms Unit, was in the process of leaving the Royal Cayman Islands Police Service headquarters at Elizabethan Square when she entered the elevator on the third floor in order to go to the ground floor. However, the elevator suddenly went to the top floor, then shot at a high speed to the ground floor before returning to the third floor, where she disembarked.
She was taken to the George Town hospital where it was determined she had multiple injuries and was placed on extended sick leave while she was being treated. As a result of the traumatic experience, she suffered serious and permanent injuries, loss, and extensive damages. These include paracentral disc protrusion, lumbar spinal injury and degenerative disease, severe back pain, double crush nerve injury, trauma to her neck, post-traumatic stress disorder, and numerous other issues.
Wignal reportedly wore a neck brace for six weeks after the incident and had to receive various medications for pain. Wignall has also had to undergo physiotherapy, three sessions each week since December 2020.
The lawsuit claims the defendants were negligent and guilty of breaching their statutory duties by failing to fulfill several obligations, including failing to provide a safe place of employment, failing to maintain or properly maintain the elevator, and acting recklessly with disregard for the safety of those using the elevator.
Wignal is claiming for general and special damages, as well as legal fees and costs.
