(CMR) Part owner of Famous Restaurant Donnette Dawkins was found guilty of employing her husband Rudolph Dawkins without a work permit in Summary Court this week. Her husband was also found guilty of working without a permit.
Rudolph Dawkins was arrested on suspicion of working without a permit last July. An affidavit was then provided by his wife regarding her employing him as part owner of the restaurant.
The man is suspected to have been working at Famous Restaurant as a cook without a work permit since March 20, 2020, based on the job letter provided by the restaurant.
According to a report by Loop Cayman, his attorney argued that he was not gainfully employed at Famous Restaurant but, instead, was merely a husband helping out his wife from time to time, as that is what a husband ought to do.
However, the judge rejected this, noting that he was not referred to as a dependent on the health insurance documents, but was noted as an employee.
The judge also rejected suggestions that the couple were “unsophisticated and relying on others for paperwork.”
According to Loop, the Magistrate pointed out that “She would not have reached the stage where she has reached in having a successful business if she was what I am told is unsophisticated and relying on others for paperwork.”
A Social Inquiry Report is to be done to assist the Court with sentencing on October 11, 2023.
