(CMR) The Royal Cayman Islands Police Service (RCIPS) Head of Media Communications Unit and Public Relations Officer, Jacqueline Carpenter, is suing her employer the RCIPS alleging workplace negligence after a slip and fall.
Recently Writ of Summons was filed on June 22nd and alleges that the RCIPS along with their janitorial company, Advance Building Maintenance Ltd. T/A ABM Cleaning Services (Janitorial) are responsible for her slipping and falling by the reception desk on March 24, 2017. She alleges that the tile floor had recently been cleaned by ABM Janitorial company and was still wet with no warning signage.
As a result she sustained a 4 centimeter laceration to nasal bone which has resulted in facial scaring. She was also admitted the ER and was off work for 5 days. She also claims tenderness and swelling, a compound fracture and a crooked cartilage. The particular of her injury indicates that she requires nasal reconstruction with scar revision surgery.
Both the RCIPS and the cleaning company are named as co-defendants in the case in which she alleges they were both negligent. The court documents state, among other things, that the RCIPS failed to take reasonable steps to ensure a safe work environment as well as exercise adequate supervision of the janitorial company.
She is claiming the cost of past and future medical treatment and expenses as well as general/special damages and related court costs and is represented by Priestleys Attorneys-at-Law.
Note: The Particulars of Negligence makes mention of the the RCIPS being in breach of section 58 of the Labour Law. However, our sources indicated that employees of the RCIPS have their police law and any aspects not covered under that would fall under the Public Services Management Law (PSML). Generally speaking the Labour Law does not apply to civil servants.
CMR has reached out to both parties for comment but have not received any by press time.
