(CMR) Theo Anthony Cummings and Santangleo Almartino Bush (Sannie Bush) are being accused of insurance fraud by Saxon Motor & General Insurance Company Limited for allegedly staging a motor vehicle accident in George Town and jointly receiving $15,400 as tortious co-conspirators.
The Summary Court Plaint claims that Cummings (28) of three possible addresses in West Bay and Bush (27) of an address in Bodden Town conspired together to have their vehicles collide at the mini roundabout at the intersection of North Sound Road., Dorcy Drive and Kentville Rd. in George Town on September 28, 2017.
Bush was driving a 2007 BMW 320i when he rear-ended Cummings' 2005 BMW 320i at 9:30 PM. Both vehicles were insured with Saxon with collision coverage and were written off with the result that Cummings recovered $7,350 for the loss of his vehicle and Bush recovered $8,050 for the loss of his.
The court document claims that Cummings was a close friend and associate of Bush and the accident was staged and prearranged by Cummings with Bush for the purposes of profiting from the insurance proceeds. The payments are made to both defendants and settlement reached for the loss and damage to the vehicles based upon representations made by them to the insurance company. The plaint contends that Saxon settled with them in good faith believing that the accident was genuine.
The insurance company is now seeking to have the settlement set aside on the basis that the defendants made fraudulent misrepresentations for the insurance money. They are claiming that the money was paid because of the “tortious deceit” by Cummings working in “tortious conspiracy” with Bush. They are seeking to recover the full amount of money paid out to both parties plus interest and court fees.
