(CMR) Convicted child molester Devon Alanzo Stewart (60) has lost his “toilet seat” appeal against his 2017 gross indecency conviction for molesting a 7-year-old child and giving her an STD after the Court of Appeal judges found that his case had no legal merit.
Devon remains in jail after being sentenced to five years and nine back in 2018. He was convicted of inserting his finger in the girl’s vagina while they were sitting in a car outside her home after he had collected her from school.
As a very close friend and neighbor, the girl’s mother had on occasion trusted Stewart to care for the child in her absence. But the mother learned about the abuse when she took the girl to the hospital after she complained of pain in her genitals. When the sexually transmitted disease was discovered, the little girl told the nurse what had happened.
Last March it was revealed exclusively on CMR that Stewart had been appealing the Governor to intervene in his loss of Cayman status and requesting access to his government pension fund. There have been no further updates on the status of that matter.
He had previously argued that the child contracted the STD, a strong evidential point relied upon for his conviction, because of a shared toilet and not because of an indecent assault. He also raises the possibility that other people in the house had the sexual infection but were never tested and that as a result, he maintains his innocence. However, the child had confided in a medical physician about the abuse after being taken to the hospital complaining of genital pain and discomfort. The court heard there was a substantial traumatic impact on the child.
For this appeal, the Court of Appeal found that his argument regarding expert evidence not being given proper weight was not sufficient for his appeal to be successful. He argued that trial Judge Tim Owen had not given his defense sufficient consideration in his judgment. Stewart remains in jail serving the remainder of his sentence and is expected to be deported upon his release. He had previously worked at the Department of Agriculture for a number of years.
