(CMR) Tony O'Connell Ebanks has been found guilty Tuesday in Grand Court of indecent assault on a young child. Justice St. John-Stevens found that the 54-year-old had done what the near toddler has accused him of after he decided to give no evidence in his own defense.
He will face the judge again next month to find out his fate.
The court heard the details of Ebanks selected the young victim and took advantage of her trust by digitally penetrating her. She then screamed for help from a family member. She later told her mother what happened and the police were called.
She was later interviewed by the police and shared what he had done to her.
During his police interview, Ebanks was asked three questions and offered a no-comment interview to the authorities. Justice St. John-Stevens said that given the young girl's age she was permitted a certain about of leeway.
A victim's impact report will be conducted by the same officer that initially interviewed the young victim so as not to traumatize her further. The judge issued directions that it should not be conducted by the probation office as would otherwise be customary.
Ebanks will be sentenced on February 4 and was remanded back to prison where he was already in police custody. He was represented by Prathna Bodden of Samson Law Associates.
