(CMR) Wilfred Ellington Myles Jr (28) was sentenced today to a six-year prison term and also received a ten-year ban from driving for killing Ignacio Kirzner (21) in April.
At the time of the incident, Myles was already disqualified from driving and not insured. It was alleged that he took his girlfriend's SUV without her permission and killed cyclist Kirzner in the early morning hours of April 17 on North Church Street as he made his way to work.
Being described as “grossly intoxicated”; it was revealed that several hours after the crash Myles tested more than two and a half times the legal limit. Justice Roger Chapple handed down his sentence this afternoon and called Myles a menace on the roads and stated that he intended to keep him off them as long as possible.
The judge expressed that he was moved by the victim impact statements and offered his condolences to the family. Kirzner was from Argentina and had recently celebrated his 21st birthday. The court acknowledged his kind and giving character as was shared by those who knew him.
Justice Chapple noted that the sentence reflected the seriousness of the offense and noted the maximum sentence available for causing death by dangerous driving was ten years. He gave him nine years and then made a deduction for the guilty plea of one third. Myles was also sentenced for other pending offenses.
The ten year ban begins upon his release from jail and would also require Myles to re-qualify at that time for a driver's license.
