(CMR) As more details emerge about the arrest of Maples partner, David Marshall, it was revealed in the criminal complaint that he left his wife unconscious on the hallway floor of their hotel room.
Marshall (49) is charged with violently assaulting his wife of 15-years on his birthday after he became intoxicated at the Faena Hotel in South Beach. It has been revealed that the hotel's security manager called 911 after his wife was found unconscious with injuries to the left side of her face. She was treated at Mount Sinai Hospital. A doctor noted that she had “at least three fractures to the left side of her face surrounding her eye” and a laceration next to the same eye.
After viewing the CCTV footage the security manager observed that the couple went into their room around 2:49 am. His wife was observed holding a towel to her face and walked down the hallway where she then passed out in front of another room number.
The manager then did a security check of the room and found signs of an altercation and woke Marshall up. Marshall admitted to being out drinking and having “an argument” and claims he could not recall anything further. He proceeded to go to the hospital room to visit his wife.
From the report, it appears that the parties attempted to cover up the assault but the hospital staff alerted police to a possible domestic battery.
A Miami-Dade police officer went to the hospital and separated Marshall from his wife observing that:
“After separating him from the victim I attempted to have a conversation with him,” stated the officer in the complaint/arrest affidavit. “At first he was not making any sensible statements. He had an odor of alcohol emitting from his mouth and had slurred speech. He was unable to maintain his balance.”
The defendant also had scratches on him that he could not explain. His wife also claimed to not recall what transpired after they got drunk and had an argument. She appeared to not want to cooperate with the police and did not want her photo taken after initially agreeing to do so.
In the end, the police were convinced based on a number of factors that Marshall should be charged:
“After reviewing the statements provided by the hotel security Frank Negron, the reports of the nurse, the inconsistency in the [sic] both the defendant and victims statement and the extent of the injuries sustained by the victim it was concluded that Mr. David Marshall (the defendant) was the primary aggressor.”
609.02 DEFINITIONS. § … “Great bodily harm” means bodily injury which creates a high probability of death, or which causes serious permanent disfigurement.
Marshall and his wife have three children together.
