(CMR) Jamaican national Roy Jackson (54) was sentenced to 6 months in jail last week for overstaying in the Cayman Islands by 15 years. He was charged with being in contravention of s.105(1)(c) of the Customs & Border Control Act (2021 Revision).
The court heard the details of how he remained in the Cayman Islands unlawfully from December 3, 2006 until August 9, 2021 contrary to the Immigration Law. Jackson was charged on November 11, 2021 and made his first court appearance on November 30. He previously held a valid work permit.
Magistrate Phillip McFarlane took some time to consider the appropriate sentence and noted that a custodial sentence was warranted to send a clear message to others that this type of behavior was not acceptable. She noted that there must be something more than a fine or warning to deter others.
The court was informed that during that time Jackson managed to otherwise remain a law abiding citizen with no arrests or known issues.
During the time that Jackson was on island he worked in construction and she noted that he was also potentially depriving someone from having that opportunity.
He should face a deportation order by Cayman Customs and Border Control after his sentence is completed.
