(CMR) Luigi Moxam, of Cayman Cabana Ltd. appeared in Summary Court last Monday, February 4 charged with 35 labour related offenses.
Moxam, a local restaurateur, has been in court for some time now dealing with a variety of matters with some of the current offenses dating back to 2017. The matters relate to several restaurant businesses including Cayman Cabana and Breezes both located in the tourist hub of George Town; on the waterfront.
At his previous court appearance in early January Moxam pleaded guilty to seven counts of failing to comply with a requirement of the Director of Labour and Pensions to produce documents and one count of failing to provide gratuities statement.
His attorney, John Furniss, indicated the gratuities statement was submitted late and that he was up to date with all requirements. He pleaded not guilty to seven counts of failing to make contributions to a pension plan and to providing false information on a trade and businesses. He further pleaded not guilty to 11 counts of failure to pay national minimum basic wages.
He faces eight charges of failing to make contributions to a pension plan on various dates between January 2015 and June 2018. One of the charges relates to himself. There are also 11 charges of failing to pay the national minimum basic wage and providing false information on a trade and business license. He entered no plea on a charge of making a false statement.
Court documents show that Moxam has claimed incorrect calculations are at the heart of the issue.
