“I never felt so unprotected”

Rape victim who was approached by prisoner Gamboa-Garcia

(CMR) A “depraved” convicted sexual offender was taken to George Town Hospital on Thursday morning where he ran into one of his victims. Colombian Michell Anderson Gamboa-Garcia (32) spoke to his victim leaving her traumatized, crying and pleading for a total stranger to help her according to eyewitnesses.

Sources shared that Gamboa-Garcia was permitted to walk up to his victim and started apologizing to her. The prison officer was said to have been on his phone and noticed that she did not respond to Gamboa-Garcia. When she did not respond, the prison guard responded, “she must not recognize who you are”.

Apparently, he was attempting to apologize to her but the entire situation left her so completely distraught that a total stranger noticed her struggling to compose herself. She walked out of the hospital, fell to the ground, and started crying and shaking uncontrollably. She then called her father for assistance. Eyewitnesses said the prison guard did nothing to assist in any way and did not report the matter to his superiors upon his return to the prison either.

Her father then called the prison to lodge a formal complaint. However, the situation has been compounded by Gamboa-Garcia's mother, Luz Adriana Garcia Lopez, who contacted the victim after finding her on Facebook. She started to beg her to withdraw her complaint claiming that they “were friends”. Lopez told her, “you guys were friends, please in the name of friendship please withdraw the complaint.”

The mother appeared upset because he has now been placed in maximum security because of the incident. Her concern for the victim and her suffering appears to not exist. However, this ordeal has left the victim “suffering mentally the entire weekend” and completely devastated.

Other eyewitnesses said he was in plain clothes and walking “behind the prisoner officer saying hello to everyone like he was some boss”.

Years into his sentence, Northward Prison has him classified as a Category D low-risk inmate meaning he is eligible for work release, can go outside of the prison gates without supervision. He lives on the F block and does not have to wear handcuffs when outside the prison including this hospital visit. However, since this incident, he has been moved to HRU – which is the maximum-security unit.

Gamboa-Garcia, a former AC technician, was sentenced to 12-years imprisonment in August 2016 for sexually assaulting a 5-year-old child, raping and committing indecent assault again a teenage girl and collecting over 1,000 pornographic images of children and distributing some of those images. Justice Micheal Mettyear described his conduct as “despicable and depraved.”

His offenses were extremely serious and included two rapes and six indecent assaults against the 15-year-old in December 2014.  That young lady is now an adult and coincidentally happened to be at the hospital at the same time as the inmate who had been transported for an appointment.

Gambo-Garcia's offenses came to light after he assaulted a 5-year-old child. The facts were reported:

“In September 2015 Garcia was called to a family home to do some repair work on an A/C unit. While there, although adults and family members were present, a curious 5-year-old girl who was playing in her room next to where Garcia was working peeked in to see what he was doing. In a matter of ten minutes, by disguising it as play, he was able to persuade the girl to take off her clothes, sexually assaulted her and then took a number of indecent images.

But the little girl immediately reported the indecent acts to her nanny and mother, who reacted quickly and bravely, the judge said, by calling the police and blocking Garcia’s van with her own car.”

It was after forensic analysis of his phone that police discovered evidence of Garcia sexually assaulting and raping a local teenage girl while she was unconscious. The police were able to identify and track down the girl, who was unaware that Garcia, whom she believed to be a friend, had raped and indecently assaulted her on at least two occasions and had taken pictures and video.

He is to be deported upon completion of his prison sentence.

It is unclear how prison policy will address any ongoing concerns this case has raised.
