Archer has issued a press statement to other media houses whereby he has informed that that he is seeking an injunction against Cayman Marl Road for the removal of our investigative story about him – published last week Thursday. Archer is alleging defamation and untrue allegations and seeking an injunction to have the original story removed.
We have not been provided with a copy of the statement. However, the administer of this page, Sandra Hill, is preparing to make legal arguments before Justice McMillan in an ex-parte hearing at 11:00am August 30th.
Hill, who is known to have won numerous court cases against government and most notably a judicial review application stated, “this lawsuit is of utmost importance because we are talking about the freedom of the press here. There is no way that I could have removed the story simply because Mr. Archer does not agree with the content and thinks it's defamatory. Defamatory is a matter of fact/law. I made every possible review of documentation to ensure that what Citizen X stated to me was verified. I find it hard to argue with documentary evidence. Freedom of the press is a fundamental requirement of any democratic society.”
At this time CMR is not in a position to make any further comments on the matter but we have faith that the initial article and supporting documents will stand up in court.
