(CMR) The 2017 lawsuit between Marco Archer and Sandra Hill and Cayman Marl Road has now been settled by way of a Consent Order which was signed off by the parties and The Honourable Mr. Justice McMillan.
The parties have agreed to the terms of the order which state that:
1. Judgement be entered in favour of the Plaintiff, with damages to be assessed.
2. The Defendant, her servants and agents shall:
(i) be restrained, from broadcasting or continuing to publish the Posts;
(ii) permanently remove the Posts from her website and/or any forms of social media where they have been published;
(iii) be restrained from further distribution of the Post;
(iv) be restrained from republishing the Posts, the allegations contained within them, or similar allegations; and
3. The Defendant shall pay the Plaintiff's costs, to be taxed if not agreed.
4. All further proceedings in this action (including the assessment of damages and taxation of costs) are stayed upon terms that only if the Defendant fails to publish the Apology or fails to comply with paragraph 2 of this Order, may the Plaintiff restore the action.
