(CMR) Cayman Marl Road reported disturbing images of an infant child being raped in 2020 to the RCIPS, which led to the arrest of Jamaican barber Kayson Ricardo Holness (33).
Holness was sentenced to 2 years and nine months in jail this year after pleading guilty to possession of child porn for the purpose of publication and two counts of transmitting child pornography.
Justice Cheryll Richards sentenced Holness to 16 months on the first count, 33 months on the second count and 12 months on the third count. However, with the sentences to run concurrently, he will serve 33 months with time served taken into consideration.
Holness was arrested in 2020 after an e-mail was sent to the Commissioner of Police by CMR providing a link to his Facebook page where he had shared a video with a male having sex with a child. A screenshot of the page was also sent to the Commissioner.
On the 20th of June, 2020, the Family Support Unit (FSU) of the Royal Cayman Islands Police Service (RCIPS) commenced an investigation into a Facebook posting from a Facebook page under the name of “Djfreshlink Holness.”
A copy of the video taken from Holness' Facebook page was also given to the police by CMR and a member of the public.
The matter was reported to Facebook authorities, who then removed the video and contacted the defendant.
The police were able to identify Holness from his Facebook account, and he was arrested on the 26th of June 2020. His Samsung mobile phone and other electronic devices were seized for forensic analysis. He was interviewed under caution in the presence of his attorney. In that interview he admitted downloading the video.
He said that prior to being contacted by Facebook that the video had been removed as it was inappropriate, he did not know that it was illegal to share those images . A forensic analysis of the defendant's Samsung phone found a number of other videos of child pornography which had been on the phone for the period 30th April 2020 to 26th June 2020.
The analysis also showed that the defendant had transmitted these videos during the period 30th April and 12th June 2020 via WhatsApp Messenger service and via Facebook on the 26th June 2020.
The child's age in one of the videos in respect of count one was estimated by Intelligence Officer Joanne Delany to be between 4 months to 18 months. The video clearly showed the baby being penetrated and crying incessantly.
Holness, the father of two teenagers, one of whom is a girl, was assessed as being at medium risk of reconviction of a sexual crime; however the prosecution applied for a Sexual Harm Prevention Order (SHPO).
