(CMR) The Royal Cayman Islands Police Association has issued a letter threatening legal action to the Commissioner of Police (CoP) stating that improper and unlawful procedures are in place presenting police officers for advancing in the force.
The letter shares that jobs have not been advertised in the past year because the management of the police are content to allow people to act in the posts instead of promoting or hiring officers.
The Letter Before Action (LBA) was served on the CoP today and also released to the media for they call “unlawful decisions in relation to and failures in the administration of promotions” with the RCIPS. It argues that the current promotions system is both improper and unfair and that the head of the police service is in contravention of his legal obligations and in breach of the Public Services Management Law (2018 Revision) as well as the Personnel Regulations (2019 Revision).
Explaining that:
Officers have been appointed by the CoP to acting roles and remain in these roles in excess of the 12-month statutory time limit.”
In some cases, they say that the acting officers have been in those roles for almost four years and that it's increasingly happening. The letter details that some 21 officers have been impacted by this and have surpassed the 12-month limit thereby denying others the opportunity to apply for those positions to possibly 57 persons who have passed the sergeant exams and another 16 sergeants who have passed the inspector examination. This has resulted in jobs advertised for upward mobility in the past three years and therefore no interview committee being convened.
