(CMR) Captain Herman's Fish Fry on Sea View Road, East End is being evicted after allegedly not paying his rent for 20 months; according to the owner of the property. The matter started to come to a head Sunday but Herman could be seen with his assistant pulling down the numerous eviction notices.
Herman secured a written 10-year lease on the property in 2012 for KY$300.00 per month with an annual increase of 5% after building the restaurant on the land. The current rent is $449.00. However, he has now alleged that he has not paid his rent since November 2018. A dispute has now ensued between him and the landowner.

The issue appears to have started after her husband passed away 2015 things started to change with Herman who she had considered a friend. Apparently she claims she was given very little warning by his previous landlord in East End where he operated another fish shack that he was not one to pay his rent.
His current landlord shared:
When he was at the gas station in doing fish fry he told me that the lady run him off, but I didn't go to her until he stopped paying me and asked what happened. It was then she shared he was not a good paymaster … she is a quiet lady and did not say much else.
The landlord shares that he has blocked her phone number and she is unable to communicate which him after he claims he received legal advice not to pay the rent. There was no reason given on what the basis for that advice would have been.
The landlord attempted to evict him with a locksmith Saturday evening but was told by the police that he should have a copy of the keys to access his building. Officers attended the scene yesterday and informed the parties that it is a civil matter and they will not get involved.
Herman was observed with a female companion removing the eviction notices that were posted at different spots throughout the property.
The fish fry is on prime ocean-view property and offers outdoor dining.
