(CMR) The Cayman Islands same-sex marriage legal debate is headed to the Privy Council in the United Kingdom after it was confirmed that the appeal process has begun. Same-sex couple, Chantelle Day and Vickie Bodden lost their most recent challenge to the Court of Appeal after the Cayman Islands Government argued that the Chief Justice erred in the initial decision.
According to CNS, attorney Ben Tonner confirmed that the documents have been filed with the Cayman Islands Court of Appeal.
The Court of Appeal would have to essentially grant the legal permission to proceed to the higher court. Day and Bodden have become unintentional advocates for the same-sex marriage debate in the Cayman Islands after the current premier, Alden McLaughlin, refused to acknowledge their correspondence seeking a non-litigious solution.
In November, the Court of Appeal took the unusual step of issuing a directive instructing the government to resolve the matter despite reversing the Chief Justice's decision. They mandated that the government legislate a solution that would give them equal footing as any other married couple. Despite the seriousness of this unusual step the government has essentially said the first part of 2020 would be focused on financial legislation as a priority.
